Privacy Policy

1. Who we are

This website, marcospattaya.com, is operated by J.L.M.P. Co., Ltd., trading as Marco's Restaurant, 306/92-94 Moo 12, Nongprue, Banglamung, Chonburi 20150, Thailand ("we", "our", "us"). We are the data controller for the personal data described in this policy under the Personal Data Protection Act B.E. 2562 (2019) ("PDPA").

2. What personal data we collect

We only collect what we need to run the restaurant and this website:

  • Reservations: your name, phone number, email address, party size, date and time, and any special requests you add (for example allergies or a birthday note).

  • Contact and feedback forms: your name, email address or phone number, and the content of your message.

  • Messages you send us on LINE, Facebook, Instagram or by email.

  • Technical data collected automatically when you visit the site: IP address, browser type, device type, pages viewed and the time of your visit. This is collected by our website provider, Wix, to operate and secure the site.

We do not take payment on this website. Delivery orders are placed through GrabFood, and dine-in payments are taken at the restaurant. We do not collect card details here.

3. Why we use your data and on what legal basis

We do not sell your personal data and we do not use it for automated decision-making.

4. Who we share your data with

  • Service providers who help us operate: Wix (website hosting and reservation system), LINE and Meta (messaging), Google (email and analytics), and our accountants. They process data on our instructions.

  • Authorities, where Thai law requires it or to protect our legal rights.

  • A buyer or successor if the business is sold or restructured, in which case this policy continues to apply.

Some of these providers store data outside Thailand (for example, Wix and Google operate servers in the United States and Europe). Where that happens, we rely on the provider's contractual safeguards and, where required by Section 28 of the PDPA, on your consent given when you use those services.

5. How long we keep your data

  • Reservation and contact data: up to 2 years after your last visit or message, so we can recognise returning guests and handle any follow-up.

  • Marketing consent: until you withdraw it.

  • Accounting records that include personal data: as long as Thai tax law requires (currently 5 years).

  • Website technical logs: as set by Wix, typically no more than 12 months.

After these periods we delete or anonymise the data.

6. Your rights

Under the PDPA you have the right to:

  • access the personal data we hold about you and receive a copy;

  • correct data that is inaccurate or incomplete;

  • delete your data, unless we are required to keep it;

  • restrict or object to certain processing;

  • withdraw consent at any time, without affecting anything done before you withdrew it;

  • receive your data in a common machine-readable format, where technically possible;

  • complain to the Personal Data Protection Committee (PDPC) if you believe we have breached the PDPA.

7. Cookies

This site uses only the essential cookies needed for it to work. We do not run advertising cookies. If we add analytics or marketing cookies in future, we will ask for your consent through a banner before they are set.

8. Children

Our website and reservation system are intended for adults. If you are under 20 years old (the age of majority in Thailand), please ask a parent or guardian to make reservations or contact us on your behalf. If we learn we have collected personal data from a minor without the required consent, we will delete it.

9. Security

We use reasonable administrative, technical and physical measures to protect your data, including the security provided by our hosting and messaging providers. No online system is completely secure, so we cannot guarantee absolute security, but we will notify you and the PDPC as required if a breach affecting your data occurs.

10. Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last changed. Significant changes will be highlighted on this page.
